The 7th edition of the book “General Terms and Conditions of IT Contracts – Effective Drafting and Use for Practitioners” by Dr. Meinhard Erben and Dr. Wolf Günther has now been published. The market for IT services is growing, and the trend towards outsourcing to external providers is also continuing. Manufacturers, dealers, suppliers and service providers use general terms and conditions that are often in the legal gray area and therefore involve major risks for all parties. Especially for non-lawyers, this book offers a comprehensible basis for reviewing, negotiating and drafting GTC clauses in the IT environment.
The 7th edition takes into account current case law and its clarification through literature and practice. Comments on existing clauses have been adapted and new clauses have been included, for example on service level agreements (SLA), price adjustments, program blocks and the use of AI (artificial intelligence). In addition, the text and the subject index have been revised and supplemented in many places.
